Terms and Conditions

These Terms and Conditions govern the contractual relationship between EcoWave Trips – Registered Trademark (hereinafter, “EcoWave”) and travelers who book any of the package trips or experiences organized under the sub-brands EcoWave Sisterhood and EcoWave School Trip.

1. Identification

EcoWave Trips – Registered Trademark
Email: info@ecowavetrips.com
Website: www.ecowavetrips.com

2. Purpose of the contract

The purpose of this document is to regulate the general conditions applicable to the package travel services organized by EcoWave, in accordance with the provisions of Spanish Royal Legislative Decree 1/2007 of November 16, approving the General Law for the Protection of Consumers and Users and other complementary laws.

3. Bookings and payments

A booking will be considered confirmed once the traveler has completed the reservation form and made the corresponding payment. The total price will be specified in the final confirmation sent by email. Payments must be made via bank transfer or through the payment methods provided by EcoWave.

4. Modifications or cancellations by the traveler

The traveler may cancel the trip at any time prior to departure by notifying EcoWave in writing. The following cancellation fees apply:

  • More than 30 days before departure: full refund, excluding any incurred costs.
  • Between 30 and 15 days before departure: 50% refund of the total amount.
  • Less than 15 days before departure: no refund will be issued.

If the cancellation is due to duly justified force majeure (serious illness, death of a close relative, natural disaster, etc.), the traveler will be entitled to a full refund of the amounts paid.

5. Modifications by the organizer

EcoWave may modify the trip conditions due to operational, weather-related, governmental, or safety reasons. In the event of significant changes, the traveler will be offered the option to accept the modification, choose an alternative trip, or cancel with a full refund.

6. Transfer of booking

The traveler may transfer their booking to another person who meets the trip requirements, provided this is notified in writing at least 15 days prior to departure. The new participant will assume the same obligations as the original traveler, including any administrative costs arising from the change (up to a maximum of 20% of the total amount).

7. EcoWave’s liability

EcoWave is responsible for the proper execution of the contracted services in accordance with the contract and applicable regulations. However, it shall not be held liable for damages, losses, or harm resulting from causes beyond its control, such as force majeure, third-party actions, or negligent behavior by the traveler.

8. Sports and risk activities

Participation in activities such as surfing, snorkeling, hiking, or other sports-related activities is undertaken at the traveler’s own risk. EcoWave strongly recommends taking out travel insurance that covers accidents, health, and repatriation.

EcoWave’s instructors and collaborating guides hold the necessary qualifications or proven experience; however, the traveler understands and accepts that these activities involve inherent risks.

9. Image rights

During trips, EcoWave may take photographs or recordings for promotional and communication purposes. By participating, the traveler authorizes the use of their image on EcoWave’s official channels, including social media and website. This consent may be withdrawn at any time by written notice to info@ecowavetrips.com.

10. Documentation and requirements

It is the traveler’s responsibility to have the necessary documentation (ID, passport, visas, medical certificates, etc.) to undertake the trip. EcoWave is not responsible for any costs or losses resulting from failure to comply with this obligation.

11. Complaints and dispute resolution

EcoWave provides travelers with a complaints form. Any disputes that may arise will be attempted to be resolved amicably. In case of disagreement, the traveler may refer to the European Online Dispute Resolution Platform (EU Regulation No. 524/2013) or to the competent consumer courts in Spain.

12. Liability insurance and guarantees

EcoWave holds civil liability insurance with an accredited insurance company, covering potential damages arising from its tourism activities. It also complies with the guarantees required by current package travel regulations.

13. Applicable law

This contract is governed by Spanish law, particularly Royal Legislative Decree 1/2007 of November 16. In the event of a dispute, the parties expressly submit to the competent courts of the consumer’s place of residence.
